Terms and Conditions

Effective Date: 16/03/2026

By activating a membership, entering the facility, or participating in any class or activity at Couper Gym and Fitness, you agree to the following Terms and Conditions.

1. Membership Eligibility

1.1 Membership is available to individuals aged 12 years and over.

1.2 Members aged 12–15 years must be always accompanied by an active member aged 16 years or over.

1.3 Proof of age may be required.

1.4 Couper Gym and Fitness reserve the right to refuse or cancel membership at its discretion.

2. Membership Type and Payments

2.1 All memberships are monthly rolling memberships.

2.2 Membership payments are collected by direct debit on the 1st of each month.

2.3 There is no joining fee.

2.4 Membership fees are payable regardless of usage.

2.5 If a payment fails, access may be suspended until outstanding balances are cleared.

2.6 Couper Gym and Fitness reserve the right to adjust membership fees with reasonable notice.

2.7 Membership billing and payment processing are managed through ClubRight.

3. Cancellation Policy

3.1 Members may cancel their membership at any time.

3.2 A minimum of 10 days’ notice before the next billing date (1st of the month) is required due to direct debit processing. This must be via Email, Phone or in person (please note cancelling your direct debit or saved card details will not cancel your membership and payment may still be taken.

3.3 If cancellation notice is received with less than 10 days before billing, the next monthly payment may still be collected.

3.4 Membership will remain active until the end of the paid billing period.

3.5 No partial refunds will be given for unused membership time.

4. Access and Security

4.1 Couper Gym and Fitness operate 24 hours per day.

4.2 Entry is via a personal access code or QR code issued to each member.

4.3 Access credentials are strictly personal and must not be shared with any other individual.

4.4 Sharing access details will result in immediate termination of membership without refund.

4.5 Lost, stolen, or compromised access credentials must be reported immediately so access can be disabled and replaced if necessary.

4.6 The gym is monitored by 24-hour CCTV for security and safety purposes.

4.7 Staffed hours vary weekly and may change without notice. Outside staffed hours, members train at their own risk.

4.8 Members must not allow any other person to enter the gym using their access credentials, including allowing someone to follow them into the facility without their own valid access ("tailgating").

5. Health Commitment and Medical Declaration

5.1 All members must complete and sign a medical declaration prior to commencing membership.

5.2 Members confirm they are medically fit to exercise.

5.3 If a member has any medical condition, injury, or health concern, they must seek medical advice before participating.

5.4 Members must inform the gym of any changes to their health status.

5.5 Members participating in classes acknowledge and agree to the medical declaration by attending and participating.


6. Assumption of Risk and Liability Waiver

6.1 Exercise carries inherent risks including injury, illness, or death.

6.2 Members voluntarily assume all risks associated with using the facility and participating in classes or training.

6.3 Couper Gym and Fitness shall not be liable for injury, loss, or damage sustained on the premises except where such loss or injury results from negligence or breach of legal duty by Couper Gym and Fitness.

6.4 Members are responsible for ensuring they use equipment safely and correctly.

6.5 Members train at their own risk, particularly during unstaffed hours.

7. Facility Use Rules

Members agree to:

7.1 Treat staff and other members with respect.

7.2 Wear appropriate gym attire and clean footwear.

7.3 Use equipment correctly and safely.

7.4 Wipe down equipment after use and maintain hygiene standards.

7.5 Re-rack weights and return equipment after use.

7.6 Not drop or intentionally misuse equipment.

7.7 Not bring illegal substances, alcohol, or weapons onto the premises.

7.8 Not engage in abusive, aggressive, or inappropriate behaviour.

Failure to follow gym rules may result in suspension or termination without refund.

8. Equipment Safety

8.1 Members must only use equipment for its intended purpose.

8.2 Equipment must be used in accordance with any instructions displayed within the facility.

8.3 Couper Gym and Fitness reserve the right to remove equipment from use for maintenance or safety reasons at any time.

9. Personal Training and Commercial Activity

9.1 Couper Gym and Fitness may have Personal Trainers operating within the facility.

9.2 Personal Training sessions are arranged directly with the trainer.

9.3 Couper Gym and Fitness is not responsible for agreements, payments, or disputes between members and Personal Trainers unless explicitly stated.

9.4 Members may not conduct personal training, coaching, or any commercial activity within the gym without prior written approval from management.

10. Classes

10.1 Classes may be included as part of membership.

10.2 Class availability may vary.

10.3 Members participate in classes at their own risk.

10.4 By attending any class, members confirm agreement with the signed medical declaration and these Terms.

11. CCTV and Data Protection

11.1 The premises are monitored by 24-hour CCTV for safety, crime prevention, and member protection.

11.2 CCTV footage may be used for investigative or legal purposes where necessary.

11.3 CCTV footage is stored securely and retained only for as long as reasonably necessary for security and investigative purposes, after which it is automatically deleted unless required for an ongoing investigation.

11.4 Personal data is handled in accordance with UK data protection law and guidance from the Information Commissioner's Office.

12. Photography and Media

12.1 Photographs or videos may occasionally be taken within the facility for promotional or marketing purposes.

12.2 Members who do not wish to appear in promotional material should inform gym staff.

13. Fire Safety

13.1 Members must follow all fire safety instructions displayed within the facility.

13.2 Emergency exits must always remain unobstructed.

13.3 Members should familiarise themselves with the locations of:

  • Emergency exits

  • Fire extinguishers

  • First aid kits

14. Damage to Property

14.1 Members are responsible for any damage caused to equipment or facilities through misuse or negligence.

14.2 Costs for repair or replacement may be charged to the member.

15. Lost or Stolen Property

15.1 Couper Gym and Fitness accept no responsibility for lost, stolen, or damaged personal belongings.

15.2 Members bring items onto the premises at their own risk.

16. Termination of Membership by the Gym

Couper Gym and Fitness reserve the right to terminate or suspend membership without refund if:

  • Terms and Conditions are breached

  • Access credentials are shared

  • Payment defaults occur

  • Behaviour is unsafe, abusive, or inappropriate

  • Criminal or illegal activity occurs on the premises

17. Amendments to Terms and Conditions

Couper Gym and Fitness reserve the right to amend these Terms and Conditions at any time.

Updated Terms will be available on request or displayed within the facility.

Continued membership or use of the gym constitutes acceptance of the updated Terms.

18. 24-Hour Emergency Procedures

18.1 Couper Gym and Fitness operate 24 hours per day, including unstaffed periods.

18.2 Members are responsible for their own safety during unstaffed hours.

18.3 In the event of an emergency, members should:

  • Call emergency services (999) if urgent assistance is required

  • Notify gym staff as soon as possible

18.4 Members should familiarise themselves with the locations of:

  • Emergency exits

  • Fire extinguishers

  • First aid kits

  • Emergency contact instructions

18.5 By using the gym during unstaffed hours, members acknowledge that emergency response may be delayed until staff or emergency services arrive and accept all associated risks.

19. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Scotland.

Any disputes arising in connection with these Terms shall be subject to the jurisdiction of the Scottish courts.

20. Agreement

By activating a membership, entering the facility, or participating in any class or activity at Couper Gym and Fitness, you confirm that:

  • You have read and understood these Terms and Conditions

  • You agree to be bound by them

  • You accept all risks associated with gym use

  • You confirm the accuracy of your medical declaration

 

CCTV Policy

1. Purpose of CCTV

Couper Gym and Fitness operate CCTV systems to promote the safety and security of members, visitors, and the facility.

CCTV is used for the following purposes:

  • Crime prevention and detection

  • Protection of members and visitors

  • Protection of gym equipment and property

  • Monitoring the safe use of the facility during staffed and unstaffed hours

  • Investigation of incidents, accidents, or breaches of gym rules

  • Supporting law enforcement where required

CCTV systems are operated responsibly and in accordance with UK data protection laws.

2. CCTV System Operator

The CCTV system is operated by:

Couper Gym and Fitness acts as the data controller for CCTV footage.

3. Location of Cameras

CCTV cameras are installed throughout the facility including:

  • Gym training areas

  • Strength and cardio equipment areas

  • Entry and exit points

  • Internal access routes

Due to the layout of the facility, all gym equipment and training spaces are covered by CCTV for safety and security purposes.

No cameras exist in any private areas. Bathrooms ect.

4. Operation of the CCTV System

CCTV operates 24 hours per day, including during unstaffed periods.

This is particularly important due to the 24-hour access nature of the gym.

The system records video and audio.

Footage may be reviewed by authorised personnel where necessary for safety, security, or investigative purposes.


5. Use of CCTV Footage

CCTV footage may be used for:

  • Ensuring the safety and security of members

  • Investigating accidents, injuries, or incidents within the gym

  • Investigating breaches of membership terms or gym rules

  • Preventing unauthorised access to the facility

  • Assisting police or authorities where required

  • Protecting the business from fraudulent claims or disputes

Access to CCTV footage is restricted to authorised personnel only.


6. Storage and Retention of Footage

CCTV footage is stored securely and protected against unauthorised access.

Footage is retained for a limited period before being automatically overwritten or deleted, unless it is required for:

  • Investigation of an incident

  • Legal proceedings

  • A request from law enforcement authorities


7. Data Protection

CCTV recordings may capture identifiable images of members and visitors.

All CCTV data is handled in accordance with UK data protection legislation and guidance issued by the Information Commissioner's Office.

Appropriate security measures are implemented to ensure footage is stored securely and accessed only when necessary.


8. Access to CCTV Footage

Individuals have the right to request access to CCTV footage containing their personal data.

Requests must:

  • Be submitted in writing

  • Include the date and approximate time of the recording requested

  • Provide sufficient information to help identify the footage

Requests may be refused or limited where disclosure would:

  • Impact the privacy of other individuals

  • Interfere with a criminal investigation

  • Be restricted under applicable law


9. Sharing CCTV Footage

CCTV footage may be shared with:

  • Law enforcement agencies

  • Insurance providers where relevant to an investigation or claim

  • Legal representatives if required

Footage will not be shared with third parties unless necessary or legally required.


10. CCTV Signage

Clear signage is displayed within the facility to inform members and visitors that CCTV recording is in operation.

This ensures transparency and compliance with data protection regulations.
